Collaborative Law is a structured process in which lawyers support their clients with both legal and strategic advice in negotiating their own resolution to family law issues. Settlement is achieved through a series of meetings between the parties and their lawyers. In this process, parties treat each other with respect and honesty and there is a binding commitment to avoid court. If one party does insist on going to court, or there is a breakdown in respect and honesty, their lawyer must resign. This gives lawyers an incentive to help the parties collaborate and arrive at a fair settlement.
